customerservice@nipandfabthefix.com
These Terms & Conditions govern your use of the Website and the purchase of products from The Fix.
Please read them carefully before using the Website or placing an order.
Our Privacy Policy also applies to your use of the Website and explains how we collect and use your personal information.
1. About The Fix
The Fix is a brand and product line operated by NIP AND FAB LIMITED.
When you purchase a The Fix product through www.nipandfabthefix.com, your contract is with NIP AND FAB LIMITED, not with a separate legal entity called The Fix.
References in these Terms to “The Fix” describe the brand through which the relevant products and services are offered.
2. Using Our Website
You may use the Website only for lawful purposes.
You must not:
- misuse the Website;
- attempt to gain unauthorised access to the Website or systems connected to it;
- knowingly introduce viruses, malware or other harmful material;
- interfere with the operation or security of the Website;
- use automated systems to extract Website content without our permission where prohibited by law; or
- use the Website in any way that infringes the rights of another person.
We may suspend, restrict or terminate access to the Website where reasonably necessary for security, maintenance, legal compliance or prevention of misuse.
We do not guarantee that the Website will always be available or uninterrupted.
3. Orders
You are responsible for checking that the information you provide when placing an order is complete and accurate.
Before submitting your order, you will normally have an opportunity to review and correct information entered during checkout.
Please check carefully:
- the products selected;
- quantities;
- billing information;
- delivery address;
- delivery method; and
- contact information.
Once an order has been submitted, please contact us as soon as possible if you identify an error:
customerservice@nipandfabthefix.com
We will make reasonable efforts to amend or cancel an order where possible, but we cannot guarantee that changes can be made once an order has entered processing, fulfilment or dispatch.
If an incorrect delivery address has been supplied, we will try to assist where reasonably possible. However, once an order has been dispatched, it may not always be possible for us or the carrier to redirect it.
You are responsible for ensuring that the delivery information supplied at checkout is accurate.
Nothing in this section affects your statutory rights.
4. Order Acknowledgement and Contract Formation
After you place an order, you will normally receive an automated email acknowledging receipt of your order.
An order acknowledgement does not necessarily mean that your order has been accepted.
Your order constitutes an offer to purchase products from us.
A legally binding contract between you and NIP AND FAB LIMITED is formed when we accept your order, normally when we send you confirmation that the relevant products have been dispatched, unless we expressly tell you otherwise.
We reserve the right to decline or cancel an order before acceptance where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product information error;
- we are unable to obtain payment authorisation;
- we reasonably suspect fraud or misuse;
- applicable purchase restrictions have been exceeded;
- we cannot deliver to the requested location; or
- accepting the order would breach applicable law.
If payment has already been taken for an order that we do not accept, we will arrange a refund.
This does not affect your statutory rights.
5. Product Availability
All products are subject to availability.
Placing an item in your basket does not reserve that product.
In rare circumstances, a product may become unavailable after you have placed an order.
If we are unable to supply an item, we will notify you as soon as reasonably possible and, where applicable, refund any amount you have paid for that item.
6. Product Information
We take reasonable care to ensure that product descriptions, photographs, ingredients, sizes, prices and other information displayed on the Website are accurate.
However, product information may occasionally change.
This may include changes to:
- formulation;
- ingredients;
- packaging;
- product appearance;
- size;
- labelling; or
- instructions.
Actual product packaging and materials may therefore occasionally contain information that differs from information displayed on the Website.
You should always read the product label, ingredient list, warnings and directions supplied with the product before use.
Where there is a material discrepancy or you believe a product is not as described, please contact us.
Product Appearance
Product packaging may vary from images shown on the Website.
Weights and dimensions may be approximate.
We make reasonable efforts to display product colours accurately. However, the colour displayed on your device may vary depending on your screen, display settings and other technical factors.
Skincare Results
The Fix products are cosmetic products.
Results may vary between individuals depending on factors including:
- skin type;
- skin condition;
- frequency and method of use;
- other products being used;
- lifestyle; and
- environmental factors.
Marketing information, product descriptions, consumer results or testimonials should not be interpreted as a guarantee that every customer will experience identical results.
If you have concerns regarding ingredients, allergies or product suitability, please review the product information carefully and contact our Customer Service team before purchasing or using the product.
7. Prices
Prices displayed on the Website are those applicable at the time they are displayed, subject to any obvious error.
For UK customers, prices displayed will normally include VAT where applicable.
Delivery charges, where applicable, will be shown separately before you complete your order.
We take reasonable care to ensure that prices are correct.
However, errors may occasionally occur.
If we identify an obvious pricing error before accepting your order, we may:
- contact you and ask whether you wish to purchase the product at the correct price; or
- cancel the relevant order and refund any amount already paid.
We are not required to supply a product at an obviously incorrect price where the pricing error could reasonably have been recognised as an error.
Prices and promotions may change from time to time.
Changes will not affect orders that we have already accepted, except where required by law.
8. VAT, Duties and International Orders
Taxes and duties applicable to your order depend on the delivery destination and the arrangements displayed at checkout.
Where applicable, VAT or other taxes may be included in the price or collected during checkout.
For international orders, import duties, local taxes or customs charges may apply depending on the destination.
Where these charges are not collected by us at checkout, you may be responsible for paying them to the relevant authority or carrier.
Any applicable information regarding taxes, duties or delivery charges will be displayed where reasonably possible during checkout.
9. Payment
We accept the payment methods displayed at checkout.
Available payment methods may change from time to time.
Payment services may be provided by third-party payment providers and may be subject to their own terms and privacy notices.
By submitting payment information, you confirm that:
- the information provided is accurate;
- you are authorised to use the selected payment method; and
- there are sufficient funds or credit available to complete the transaction.
Payment may be authorised, reserved or charged at different stages of the ordering process depending on the payment method and payment provider used.
The timing of payment does not itself determine whether we have accepted your order.
If your payment provider refuses or does not authorise payment, we will not be responsible for delays or failure to dispatch resulting from that refusal.
10. Delivery
We deliver to the destinations made available through the Website and checkout.
Available destinations and delivery services may change from time to time.
Delivery options, estimated delivery times and applicable charges will be displayed during checkout or on our Delivery information page.
Unless otherwise stated, references to working days exclude Saturdays, Sundays and UK Bank Holidays.
Delivery estimates are estimates only unless we expressly agree a guaranteed delivery date.
We are not responsible for delays caused by circumstances outside our reasonable control, although your statutory rights regarding delivery are not affected.
If we become aware of a material delay, we will take reasonable steps to inform you.
Customs
International shipments may be subject to customs procedures or security checks which are outside our control.
These may delay delivery.
Risk
Risk in the products passes to you when the products are delivered to you or to another person identified by you to receive them, except where applicable law provides otherwise.
11. Cancelling an Order Before Dispatch
If you wish to cancel an order before it has been dispatched, please contact us as soon as possible:
customerservice@nipandfabthefix.com
We will make reasonable efforts to stop the order.
However, due to the speed of our fulfilment process, we cannot guarantee that an order can be cancelled once it has been placed.
If the order has already been dispatched, you may need to return it in accordance with the cancellation and returns provisions below.
Your statutory rights are not affected.
12. Your Right to Cancel an Online Purchase
If you are a UK consumer purchasing online, you normally have a legal right to change your mind and cancel your contract without giving a reason.
Subject to applicable exceptions, the cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
Where an order contains multiple goods delivered separately, the applicable cancellation period may run from receipt of the last relevant item as provided by law.
To exercise your right to cancel, you must clearly tell us that you wish to cancel within the applicable cancellation period.
You can contact us at:
customerservice@nipandfabthefix.com
You do not need to provide a reason for cancellation.
After notifying us of your cancellation, you must return the applicable goods within the timeframe required by law, normally within 14 days.
Exceptions for Sealed Products
The statutory right to cancel may not apply to certain sealed goods which are not suitable for return for health protection or hygiene reasons once they have been unsealed, where the applicable legal requirements for that exception are satisfied.
This may apply to certain cosmetic or skincare products once their relevant hygiene or protective seal has been broken.
This exception does not affect your rights if a product is faulty, damaged or not as described.
13. Change-of-Mind Returns
In addition to and consistent with your statutory cancellation rights, products returned because you have changed your mind should:
- be returned within the applicable return period;
- be returned with appropriate packaging;
- not have been used beyond what is reasonably necessary to establish their nature, characteristics and functioning; and
- where applicable for hygiene-protected products, remain sealed if opening the seal would remove the statutory cancellation right.
Unless we state otherwise, you are responsible for the direct cost of returning change-of-mind items.
We recommend obtaining proof of postage.
You remain responsible for returned goods until they are received by us, subject to your rights under applicable law.
Please include sufficient information for us to identify your return, such as your:
- order number;
- name; and
- contact details.
14. Refunds for Cancelled Orders
Where you validly exercise your statutory right to cancel, we will refund the payments due to you in accordance with applicable law.
This will normally include the price paid for the returned goods and, where legally required, the cost of the least expensive standard delivery method we offered.
If you selected a more expensive delivery service, such as express or premium delivery, we are not required to refund the additional amount above the standard delivery cost.
We may reduce a refund to reflect any reduction in the value of the goods caused by handling beyond what would reasonably be permitted when examining the goods in a physical shop.
We will normally issue the refund using the same payment method used for the original transaction unless otherwise agreed.
We may withhold the refund until:
- we have received the goods back; or
- you provide evidence that you have returned them,
whichever occurs first, where permitted by law.
We will process refunds within the timeframe required by applicable law.
After we issue a refund, your bank or payment provider may require additional time to credit the amount to your account. This processing time is outside our control.
15. Faulty, Damaged, Incorrect or Missing Products
Nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
Products must meet the standards required by applicable consumer law, including being:
- of satisfactory quality;
- fit for purpose where applicable; and
- as described.
If a product arrives damaged, incorrect or with an item missing, please contact us as soon as reasonably possible.
Where possible, contacting us promptly helps us investigate delivery and fulfilment issues.
We may ask you to provide reasonable evidence necessary to investigate the issue, such as:
- photographs of the product;
- photographs of the packaging;
- batch or product codes;
- your order number; and
- details of the issue.
Any request for evidence will not remove or improperly restrict your statutory rights.
Product Performance and Individual Results
A cosmetic product is not necessarily faulty simply because the results experienced by one customer differ from those experienced by another.
Individual skincare results may vary.
Similarly, the following circumstances do not automatically mean that a product is faulty:
- incorrect use;
- inappropriate storage;
- failure to follow the supplied instructions;
- use with incompatible products;
- normal differences in texture, fragrance or appearance;
- minor batch variations within normal manufacturing tolerances; or
- normal settling or separation that does not affect the product's safety or conformity.
However, nothing in this section limits your rights where the product fails to meet the standards required by law.
16. Promotions and Promotional Codes
From time to time, The Fix may offer:
- discount codes;
- gifts with purchase;
- bundles;
- introductory offers;
- free delivery promotions;
- multi-buy promotions; or
- other promotional offers.
Individual promotions may have their own terms and eligibility requirements.
Unless the relevant promotion states otherwise:
- promotional codes cannot be combined with other promotional codes or offers;
- promotions apply only during the advertised promotional period;
- promotions are subject to product availability;
- excluded products or categories may apply;
- minimum spend thresholds may apply;
- gifts are subject to availability; and
- promotional benefits have no cash value and cannot be exchanged for cash.
Where the terms displayed for a specific promotion differ from this section, the specific promotional terms will apply to that promotion.
We reserve the right to withdraw, amend or suspend a promotion where reasonably necessary, provided that this does not affect orders already accepted or your statutory rights.
17. Competitions and Prize Promotions
From time to time, The Fix may operate competitions, prize draws or other prize promotions.
Each promotion may be subject to specific terms provided at the time of entry.
Unless otherwise stated in the specific promotional terms:
- entrants must meet the eligibility criteria stated for the promotion;
- employees of NIP AND FAB LIMITED and individuals directly involved in administering the promotion may be excluded;
- prizes are non-transferable;
- no cash alternative will be offered unless expressly stated;
- entries received after the closing date will not be accepted;
- fraudulent, automated, duplicate or otherwise ineligible entries may be rejected; and
- we may substitute a prize with an alternative of equal or greater value where reasonably necessary.
Any use of personal information associated with a competition will be handled in accordance with our Privacy Policy and any privacy information supplied with the relevant promotion.
Additional terms displayed for a specific competition or prize promotion will take precedence over this general section where there is a conflict.
18. Intellectual Property
All intellectual property rights in or relating to the Website and its content are owned by or licensed to NIP AND FAB LIMITED or the relevant rights holder.
This includes, where applicable:
- the The Fix name and branding;
- the Nip + Fab name and branding;
- trade marks;
- logos;
- product names;
- photographs;
- videos;
- graphics;
- product descriptions;
- Website design;
- text and editorial material; and
- other Website content.
You may access and use the Website for your personal, non-commercial use.
Except as permitted by law, you may not reproduce, distribute, modify, copy, commercially exploit or otherwise use our intellectual property without prior permission from the relevant rights holder.
Nothing in these Terms grants you ownership of any intellectual property rights.
19. Third-Party Websites and Services
The Website may contain links to websites or services operated by third parties.
These links are provided for information or convenience and do not necessarily mean that we endorse the third party or its products or services.
We do not control third-party websites and are not responsible for their content, availability or privacy practices.
Third-party services used in connection with your purchase, such as payment or delivery providers, may also operate under their own applicable terms.
20. Website Content
We take reasonable care when preparing the Website and aim to keep its content accurate.
However, Website content is provided for general information and product purchasing purposes.
Except where required by law, we do not guarantee that:
- all Website content will always be completely accurate or current;
- the Website will always be available;
- the Website will be free from technical errors; or
- every feature will operate continuously.
We may update, remove or modify Website content from time to time.
Nothing on the Website is intended to constitute medical advice or replace advice from an appropriately qualified healthcare professional.
21. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights relating to products;
- products that are not of satisfactory quality, fit for purpose or as described where those rights apply; or
- any other liability that cannot legally be excluded or limited.
If you are a consumer, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable.
Unless otherwise required by law, products sold through the Website are supplied for private and domestic use.
If you use products for commercial, business or resale purposes, different liability considerations may apply.
We are not responsible for losses caused solely by events outside our reasonable control, subject always to your statutory rights.
22. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform our obligations where caused by circumstances outside our reasonable control.
These may include events affecting:
- transportation networks;
- postal or courier services;
- customs;
- telecommunications systems;
- payment systems;
- utilities;
- severe weather;
- natural disasters;
- industrial action;
- government action; or
- other events that we could not reasonably prevent.
Where such an event materially affects your order, we will take reasonable steps to minimise the impact and will comply with our obligations under applicable consumer law.

Our Customer Service team can normally investigate orders purchased directly through www.nipandfabthefix.com.

If you are dissatisfied with the outcome of a Customer Service enquiry, you may ask us to review the matter as a formal complaint.
We aim to respond to formal complaints within a reasonable period, taking into account the nature and complexity of the issue.

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
26. No Waiver
If we do not immediately enforce a right or remedy available to us under these Terms, this does not mean that we have waived that right or remedy.
A waiver on one occasion will not constitute a waiver on another occasion.
27. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to:
- our Website;
- our products or services;
- our business practices;
- payment or delivery arrangements; or
- applicable legal or regulatory requirements.
The version of the Terms applicable to an order will generally be the version in force when that order was placed.
We will update the “Last updated” date at the top of this page when these Terms are revised.
